DRBC must remain vigilant against PennEast: Send a letter

The Delaware River Basin Commission has the authority to stop PennEast. PennEast has challenged DRBC’s authority to review phase I of their proposal to build the project in two phases. FERC has not approved PennEast’s phased proposal.

In October, we and other opponents of the project wrote to the DRBC urging the agency to remain firm in asserting their authority over the project. DRBC must review the impacts of the entire project in Pennsylvania and New Jersey in relation to their comprehensive management plan to protect water quantity and quality in the Delaware River Basin.

DRBC can stop PennEast and save our communities and the Delaware River Basin from the dangers this pipeline poses.

The Letter

Dear DRBC,

I oppose the PennEast project because it is a threat to the water resources in the Delaware River Basin, and am writing to ask the Delaware River Basin Commission (DRBC) to continue to strongly assert your jurisdiction over the project and to prevent it from damaging the water resources you are charged with safeguarding for the millions of people that rely on them for clean water.

As DRBC clearly informed FERC in its letter from March 30, 2020, “[b]ased on PennEast’s submissions to the FERC, DRBC review and approval are required prior to the commencement of any substantial construction activity or related preparation of land.” DRBC notified FERC again in June that, “with the exception of those portions of the Project located outside of the Delaware River Basin, PennEast’s planned Phase 1 natural gas transmission main meets the Compact’s definition of “project.”

DRBC has been abundantly clear that PennEast’s phased pipeline project meets the review threshold of the Commission’s Rules of Practice and Procedure. However, PennEast has repeatedly challenged the Commission’s authority to review the project.

PennEast has not received approval from FERC to construct the project in two phases.  I respectfully urge the DRBC to use your full authority to review the impacts of both phases of the project in relation to your comprehensive management plan.
