PennEast pipeline would damage more than 4,300 acres of preserved open space in New Jersey.

In March, New Jersey’s Attorney General told PennEast that it could not seize New Jersey public lands for its pipeline route, taking legal action to defend against seizing State preserved lands.

A recent court decision gave PennEast the right to condemn lands set aside with tax-payer dollars for our children and grandchildren, as well as the properties of scores of homeowners in the path of their unneeded pipeline. This will enable them to take nearly 150 properties through eminent domain, even though the project is far from having all of its required approvals.

Don’t let New Jersey take a step backward.

PennEast’s abuse of eminent domain in New Jersey does not mean that its proposed pipeline is approved.

PennEast can’t construct the pipeline without approval from the New Jersey Department of Environmental Protection and Delaware River Basin Commission. Construction would damage over 4,300 acres of preserved open space, habitat for threatened and endangered species, and 38 of the cleanest, protected streams in our state.

Dear Gov. Murphy,
 
Thank you for your continued efforts to defend against PennEast’s seizure of state lands set aside for our children and grandchildren with taxpayer dollars. I am outraged by the recent court ruling allowing PennEast to condemn nearly 150 public and private properties for its pipeline, since the proposed pipeline is far from having all of the necessary approvals. An unneeded gas pipeline will jeopardize New Jersey’s clean energy goals, and put our land, water, air, and communities at risk.
 
Despite the court ruling which you are still challenging, PennEast does not have approval to do any construction on these lands without permits from NJDEP and the Delaware River Basin Commission.
 
NJDEP has independent authority and a responsibility to protect our water and natural resources under the Clean Water Act and state regulations.
 
PennEast threatens protected wetlands and 38 high-quality C1 streams that provide habitat to threatened species of wildlife and feed into the Delaware and Raritan Canal, the source of drinking water for over one million residents.
 
When PennEast submits an application to cross these invaluable waterways, we believe that NJDEP, after careful consideration of the facts and NJ law, will find that PennEast simply cannot show the required data to prove that its project could be constructed without harming state waters. 
 
At the time PennEast submits a complete application with all the required critical survey data, we ask you to ensure that the state uses its full existing authority to protect New Jersey waters and wetlands from PennEast’s unneeded, dirty and dangerous pipeline.
